The Alaska Child Support Laws\u00a0<\/strong>set forth for the courts and the Child Support Services Division determine the rules for who should pay child support and how much. The guidelines take into account income of each of the parents, health care needs and coverage for the children, educational needs of the children, as well as the employment status of the parents. Modifications can be made if there is a material change in circumstances of the children or the parents.<\/p>\n RULES OF CIVIL PROCEDURE Part XII. SPECIAL PROCEEDINGS<\/strong><\/p>\n (Current through October 15, 2023)<\/b><\/span><\/p>\n Rule<\/b> <\/b>90.3. <\/b>Child Support Awards.<\/b><\/span><\/span><\/span><\/p>\n Guidelines\u2014Primary<\/b><\/span> <\/b>Physical<\/b><\/span> <\/b>Custody.<\/b><\/span> <\/b>A<\/span> child<\/span> support<\/span> award<\/span> in<\/span> a<\/span> case<\/span> in<\/span> which<\/span> one<\/span> parent<\/span> is<\/span> awarded<\/span> primary physical<\/span> custody<\/span> as<\/span> defined<\/span> by<\/span> paragraph<\/span> (f)<\/span> will<\/span> be<\/span> calculated<\/span> as<\/span> an<\/span> amount<\/span> equal<\/span> to<\/span> the<\/span> adjusted<\/span> annual<\/span> income<\/span> of<\/span> the<\/span> non- custodial parent multiplied by a percentage specified in subparagraph<\/span> (a)(2).<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n Adjusted annual income as used in this rule means the parent\u2019s total income from all sources<\/span> minus:<\/span><\/span><\/p>\n mandatory deductions such<\/span> as:<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n federal, state, and local income<\/span> tax,<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n Social Security tax or the equivalent contribution to an alternate plan established by a public employer, and self- employment<\/span> tax,<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n medicare<\/span> tax,<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n mandatory union<\/span> dues,<\/span><\/span><\/p>\n<\/li>\n mandatory contributions to a retirement or pension<\/span> plan;<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n voluntary<\/span> contributions<\/span> to<\/span> a<\/span> retirement<\/span> or<\/span> pension<\/span> plan<\/span> or<\/span> account<\/span> in<\/span> which<\/span> the<\/span> earnings<\/span> are<\/span> tax-free<\/span> or<\/span> tax-deferred, except<\/span> that<\/span> the<\/span> total<\/span> amount<\/span> of<\/span> these<\/span> voluntary<\/span> contributions<\/span> plus<\/span> any<\/span> mandatory<\/span> contributions<\/span> under<\/span> item<\/span> (a)(1)(A)(v)<\/span> above may not exceed 7.5% of the parent\u2019s gross wages and self-employment<\/span> income;<\/span><\/span><\/p>\n<\/li>\n child or spousal support from different relationships<\/span> for<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n prior children that is required by other court or administrative proceedings;<\/span> and<\/span><\/span><\/p>\n<\/li>\n former spouses that is required by other court or administrative proceedings and actually<\/span> paid:<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n in-kind support for prior children in the primary or shared physical custody of the parent that<\/span> is:<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n for primary custody, the amount calculated under subparagraph (a)(2);<\/span> or<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n for shared custody, the amount calculated under subparagraph (a)(2), multiplied by the percentage of time that parent<\/span> has<\/span> physical<\/span> custody<\/span> of<\/span> the<\/span> prior<\/span> children;<\/span> however,<\/span> the<\/span> total<\/span> amount<\/span> deducted<\/span> under<\/span> this<\/span> sub-item<\/span> and<\/span> any<\/span> deduction for the same children under item (a)(1)(C) may not exceed the amount calculated under subparagraph<\/span> (a)(2);<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n work-related child care expenses for the children who are the subject of the child support order;<\/span> and<\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n health<\/span> insurance<\/span> premiums<\/span> paid<\/span> for<\/span> health<\/span> insurance<\/span> coverage,<\/span> including<\/span> dental<\/span> and<\/span> vision<\/span> coverage,<\/span> by<\/span> the<\/span> parent and<\/span> Alaska Rules<\/h1>\n
